Welcome to American Credit. Here’s what you need to know:

• Eligibility: You must be 18 or the legal age of majority in your state to use our services.

• Use of Services: Don’t misuse, copy, or exploit our website or services.
• SMS Texting: You can opt in by texting JOIN, opt out anytime with STOP, and reply HELP for assistance. Standard message/data rates may apply.
• Disputes: If we ever disagree, disputes are resolved through binding arbitration, not jury trials or class actions.
• Liability: Our maximum liability is limited (see below).
• Changes: We may update these Terms. Continued use means you accept the changes.

Full Terms of Service

These Terms of Service, along with all other policies, agreements, disclaimers, and disclosures incorporated herein by reference or otherwise displayed on the Site (collectively, the “Terms”), set forth a legally binding agreement between you and American Credit (“Company”, “we” or “us”). These Terms govern your access to and use of the websites owned and operated by Company that link to these Terms, including the website located at https://americancredit.com/ (the “Site”), as well as the features and services made available or enabled via the Site (collectively, the “Services”).

If you do not agree to these Terms, you may not use the Services.

⚖ ARBITRATION NOTICE: THESE TERMS CONTAIN A BINDING ARBITRATION CLAUSE (SECTION 19) AND CLASS ACTION WAIVER (SECTION 20). PLEASE READ THESE CAREFULLY.

1. Acceptance of Terms

By accessing or using the Services, or by clicking on the “I Accept” button when prompted, you agree to be bound by these Terms and applicable laws. Additional terms or policies may apply to certain features (“Additional Terms”). All Additional Terms and Company Policies are incorporated into these Terms.

5. License Grant

Subject to these Terms and your compliance, we grant you a limited, personal, non-transferable, non-assignable, non-sublicensable, non-exclusive, terminable, and revocable license to access and use the Services and Company Content. 6. Restrictions on Use

8. Copyrights, Trademarks & Proprietary Rights

All content, code, trademarks, logos, and intellectual property belong to Company or licensors. You may not exploit, copy, or redistribute without permission. Feedback is non-confidential and may be used by Company freely.

9. Monitoring & Copyright Complaints

We may monitor, remove, or restrict content but are not obligated. We may terminate repeat infringers. To file a DMCA complaint, submit the required details to info@americancredit.com.

10. User Content

You are solely responsible for your content. By submitting, you grant us a perpetual, royalty-free, worldwide license to use, modify, display, distribute, and commercialize your content. You warrant you own the rights. You waive moral rights where allowed by law.

11. Third-Party Sites

We may link to external sites not controlled by us. We are not responsible for their content, policies, or actions. Direct complaints to those third parties.

12. Updates & Modifications to Services

We may change, suspend, or discontinue Services at any time. Information may not always be complete or current.

13. Disclaimer of Warranties

The Services are provided “AS IS” and “AS AVAILABLE” with no warranties of any kind, including merchantability, fitness for a purpose, and non-infringement. We do not guarantee uninterrupted or error-free use.

14. Limitation of Liability

Company and affiliates are not liable for indirect, incidental, or consequential damages. Maximum cumulative liability is $100. Some jurisdictions may not allow exclusions, so certain limitations may not apply.

15. Indemnification

You agree to defend and indemnify Company Parties against claims arising from your breach of Terms, use of Services, violation of rights, or User Content. We may assume exclusive defense at our expense.

16. Force Majeure

We are not liable for delays or failures due to events beyond reasonable control (e.g., natural disasters, war, labor disputes, power outages).

17. Notices

We may notify you electronically, via email, postings, or mail. Electronic notices satisfy legal requirements for written communication.

18. Governing Law

These Terms are governed by California law, without regard to conflict-of-law rules.

19. Binding Arbitration

Disputes must be resolved by confidential arbitration in Los Angeles, CA, under AAA Commercial Rules before one arbitrator. Each party bears its own legal fees, unless otherwise ordered by the arbitrator. Arbitration must conclude within 120 days. Award is binding and may be enforced in court. Proceedings are confidential.

20. Class Action Waiver

Arbitration is individual only. You waive rights to class actions, representative claims, or private attorney general actions. Arbitrator cannot consolidate claims of multiple persons.

21. Miscellaneous

Section headings are for convenience only. Failure to enforce provisions is not a waiver. Company may assign rights without notice. Invalid provisions are severable. These Terms constitute the entire agreement.

22. SMS Communications

By providing your mobile number, you agree to receive SMS communications from American Credit.

• Opt-In: You may opt in to receive SMS messages by (a) providing your phone number during enrollment or account setup, and (b) confirming consent by texting JOIN.
• Message Frequency: Typically up to 2 messages per month (frequency may vary). American Credit reserves the right to adjust frequency. Neither American Credit nor carriers are responsible for delayed or undelivered messages.
• Message and Data Rates: Standard message and data rates may apply based on your carrier’s terms.
• Opt-Out: Reply STOP at any time to unsubscribe. You will receive one final confirmation message.

• Privacy: Your information will be handled in accordance with our Privacy Policy.
• Liability: American Credit is not responsible for charges, errors, delays, or undelivered messages caused by carriers or third-party service providers.
